    Cruz: Obama’s DOJ wants foreign treaties to trump Constitution, Second Amendment

    More than one person has forwarded along this story, of the Obama Administration’s latest attempt to make an end-run around the Constitution.
    Justice Department attorneys are advancing an argument at the Supreme Court that could allow the government to invoke international treaties as a legal basis for policies such as gun control that conflict with the U.S. Constitution, according to Sen. Ted Cruz, R-Texas.
    Their argument is that a law implementing an international treaty signed by the U.S. allows the federal government to prosecute a criminal case that would normally be handled by state or local authorities.
    That is a dangerous argument, according to Cruz.
    “The Constitution created a limited federal government with only specific enumerated powers,” Cruz told the Washington Examiner prior to giving a speech on the issue today at the Heritage Foundation.
    “The Supreme Court should not interpret the treaty power in a manner that undermines this bedrock protection of individual liberty,” Cruz said.
    On the surface, this appears to be a naked power grab by the executive branch. A President constrained by the Constitution and laws of the United States could simply have his Secretary of State sign any treaty he desires, and then use that treaty signing to assert expanded executive branch powers.
    Presumably, among the first powers that this President would include the U.N. Arms Trade Treaty (ATT) that Secretary of State John Kerry signed on Obama’s orders that the U.S. Senate refused to ratify because of fears that it could be in conflict with the Second Amendment.
    If this is indeed what Department of Justice and Obama White House intend, they are playing a very dangerous game that could result in an open revolt against an Administration that is already plummeting in popularity.

    Biden Advises Shooting Shotgun Through Door

    Virginia Beach man charged for doing exactly that

    Vice President Joe Biden told Field & Stream magazine in an interview published Monday, "[if] you want to keep someone away from your house, just fire the shotgun through the door."

    Coincidentally, a 22-year-old man in Virginia Beach, Va., was charged Monday with reckless handling of a firearm after doing just that a couple days earlier.

    Local TV station WAVY 10 reports that the man observed two masked men leaning into his bedroom window. The men allegedly had weapons and told him to close his bedroom door. He stepped outside of his bedroom and did as instructed, then fired his shotgun through the closed door and then several more times at the window.

    According to the news report there were no injuries and the suspects were not apprehended by police.

    Biden's comments to Field & Stream came as he summarized a hypothetical question in which someone from California pondered "when the end days come" or if there's an earthquake.

    Earlier this month, Biden told an interviewer that he had advised his wife, Jill, "if there's ever a problem, just walk out on the balcony here, walk out and put that double-barrel shotgun and fire two blasts outside the house."

    According to Delaware attorneys contacted by U.S. News, in Biden's home state it is only legal to use deadly force if there is reason to fear imminent loss of life. Shooting a gun in the air could result in felony reckless endangering and aggravated menacing charges, in addition to misdemeanor charges, the lawyers said.

    In December, Biden was selected by President Barack Obama to lead a task force on establishing new federal gun control laws. In January, Biden presented Obama will proposals including limiting the bullet capacity of gun magazines and establishing universal background checks for all gun purchases.

    A spokeswoman for Biden did not immediately respond to a request for comment.
