View Full Version : No jail time for man whose deadly boat crash led to 'Sheyenne's Law'

CHARLOTTE, NC (FOX 46) - The man convicted of operating a boat while being drunk and killing a Concord, NC teen on Lake Norman in 2015, in an incident which sparked the creation of stricter boating laws in the state, will not face jail time, court officials say.

Keith*Cerven*pleaded no contest and was found guilty by a judge on Wednesday to a felony charge of involuntary manslaughter in the death of Sheyenne Marshall, according to the the Iredell County Clerk of Superior Court's Office.

Cerven's 16-29 month-prison sentence was suspended to 60 months supervised probation, officials say. If Cerven remains in compliance during the first 30 months of his sentence, he could be transferred to 30 months unsupervised probation for the remainder of his sentence, according to the Clerk of Court's Office.

Officials say Cerven was ordered by the court to pay more than $14,000 in fines, which include funeral costs to Sheyenne's family, and he was ordered to have a substance abuse assessment.

Sheyenne, 17, a rising senior at Cox Mill High School, was hit and killed on July 4, 2015 when she was kneeboarding on Lake Norman.

"We knew from the start it isn’t fair, but any length of time is not enough time," Sheyenne's father, Kenny Marshall, said.

Authorities say*Cerven was operating the boat that hit*Sheyenne and had been drinking. Cerven reportedly had a blood alcohol content of .14. He was charged with involuntary manslaughter and boating while intoxicated.

After her death, Sheyenne's family*pushed lawmakers to pass Sheyenne's Law,*which strengthens the penalties against drunk boaters who cause serious injury, or death.*
