Councilwoman attacked outside Islamorada home
BY JOSH GORE Free Press Staff
jgore@keysnews.com
ISLAMORADA -- A Tennessee man wearing just a sweater and underwear attacked a village councilwoman outside her home early Sunday, according to police reports.

At about 12:30 a.m. Jan. 25, Islamorada Vice Mayor Deb Gillis, who owns a local motel and lives on the premises, called deputies to report she had been beat up by a stranger outside her mile marker 82 apartment.

According to a Monroe County Sheriff's Office incident report, Gillis heard a knocking on her downstairs backdoor. When she opened it, she said a man she didn't recognize grabbed her and began beating her with a stick.

"The man stated it was because he loved her and continued beating Gillis," the report reads.

In a struggle, Gillis ripped the sweater off her assailant, whose only other article of clothing was white boxer briefs. It turned out the sweater belonged to Gillis and was likely taken out of her unlocked vehicle.

When deputies arrived, they found William Roberts, 66, not far from the scene, and Gillis identified the man as her attacker.

Roberts, 66, was charged with aggravated battery and burglary, both felonies.

Deputies later found the wooden end to a plunger nearby, a stick similar to what Gillis described as the tool used to beat her.

Gillis suffered an abrasion just above her lip on the left side of her mouth, according to the incident report. She also had a bloody ear as well as discolored bruising above her left eye.

Gillis told the Free Press the police report is accurate and declined further comment.

Mayor Mike Forster, who had spoken with Gillis, said she is recovering from the incident.

"She is doing fine," he said. "She is a little beat up. It was a traumatizing event."

Forster said he believes Roberts was a customer in one of Gillis' units and described him as "out of his mind."

Man, 40, injured in dive from pier
BY ADAM LINHARDT Citizen Staff
alinhardt@keysnews.com
A 40-year-old tourist was airlifted to a Miami hospital Thursday night after he jumped head-first into shallow water from a pier at the The Sunset Tiki Bar and Grille at the Galleon Resort and Marina on Front Street, according to Key West police.

Bernard J. Barlow III, of Norwell, Massachusetts, was drinking shortly before 5:30 p.m. when he reportedly put his drink down and ran toward the water, witnesses told police.

"The witnesses stated Barlow then jumped over the ropes next to the tiki bar and jumped into the water head-first," reports say. "The witnesses stated they were in shock and could not believe that Barlow jumped into the shallow water."

There was a very low tide at the time of the incident and Barlow's head hit hard rock, said Key West police officer Steve Torrence. Barlow was complaining that he couldn't feel anything below his neck, Torrence added.

Michael Riggleman, a 64-year-old teacher from Delaware on vacation with his wife and another couple, said one man jumped into the water feet-first and was followed by Barlow, who went "straight down" in about 3 feet of water. Reports state Barlow is 6-foot tall.

Barlow was not moving, but appeared to be semiconscious after the dive, Riggleman said. Reports state he was bleeding from several scratches to his head.

There were about 20 to 25 people at the bar when the incident occurred, Riggleman said.

"He was limp in the water," Riggleman said. "His friend who went in first pulled him to the side. An (off-duty) nurse came down and I heard someone say that he (Barlow) said he couldn't feel anything below his neck."

Police arrived to find the nurse stabilizing Barlow's body so he couldn't move his head.

Riggleman was just arriving to the bar when the first man ran by him, he said.

"They were a couple of guys who were enjoying the day, but how much they had to drink, I don't know," Riggleman said.

Whether Barlow was paralyzed or broke his neck in the jump could not be verified. He was flown from Lower Keys Medical Center to Kendall Regional Medical Center in Miami.

"There's been multiple accidents around the island over the years of people diving off piers and being seriously hurt," Torrence said, adding that often alcohol is involved. "The water is often more shallow than it appears. We locals know it's shallow, but visitors don't always have that knowledge."

Most recently in 2010, a former star college baseball player from Naples, Ryan Duffy, was paralyzed from the neck down after jumping from the pier at The Reach resort, 1435 Simonton St.

Authorities: Suspected burglar nabbed fresh from shower
CITIZEN STAFF
A Miami man was jailed Tuesday after police said he ransacked a home in New Town, swiped a laptop and fled on foot to Stock Island -- where he surprised a woman by turning up in her bathroom wearing only a towel.

Zelvion Thomas Jr., 22, was arrested on suspicion of burglary, theft and criminal mischief and booked into the Stock Island jail.

For a couple of hours Tuesday morning, police say Thomas led them on an odd chase that started on Eagle Avenue, headed to some shops on U.S. 1 on Stock Island and went through some mangroves before ending up at a woman's home on Balido Street at about 12 p.m.

"When she confronted him, he told her he'd not stolen anything," Deputy Becky Herrin said in a statement. "He told her he'd just showered in her bathroom."

Facing a barking K9 dog and two police officers, Thomas reportedly surrendered when caught in the backyard of the Balido Street home.

Thomas "immediately dove onto the ground with his hands extended out," Officer Thomas Anglin wrote in a report released Wednesday.

Thomas is accused of stealing about $2,300 worth of items from a man's home in 3600 block of Eagle Avenue, including a Dell Inspiron 17-inch laptop, a Canon digital camera, two watches, two pairs of Sperry loafers, some Perry Ellis cuff links, a three-pack of Calvin Klein underwear and a three-pack of Polo undershirts.

The stolen goods were found left behind the WeCycle bike shop, 5160 U.S. 1, inside a bright yellow Kai-Kai sandals bag, police said.

The resident of the burglarize Eagle Avenue home identified all of the items as his, Officer Kuniko Keohane wrote.

Earlier Tuesday, another officer said he spotted a man carrying a bright yellow Kai Kai bag -- with a laptop sticking out of the top -- while walking northbound on U.S. 1.

When the man noticed the police officer he "immediately began running away from him," Keohane wrote, and ran behind WeCycle before cutting through a yard, jumping a concrete wall and then entering a patch of mangroves.

The man then stripped off two shirts and put them in the yellow bag, which he left behind, and entered the mangroves, police said.

Key West police and Monroe County Sheriff deputies set up perimeters throughout the foot pursuit.

The Key West police K-9 dog, Ben, assisted in tracking down the suspect.

Thomas reportedly left his orange bicycle behind on Eagle Avenue. The bike was tracked to Boyd's Key West Campground, where an employee said he had sold one to a "young, tall, thin black male," Keohane wrote.

The employee later identified Thomas as the bike buyer, police said.

Police: Pier injury caused by drunkenness
BY GWEN FILOSA Citizen Staff
gfilosa@keysnews.com
The man airlifted to Miami after falling from the White Street Pier on Wednesday was allegedly drunk and belligerent before falling asleep atop the seawall Wednesday morning, according to police.

“I believe [the man] was under the influence of alcohol,” wrote Officer Gustavo Medina in an incident report released Thursday.

The 57-year-old homeless man remained in critical condition Thursday and also unidentified by Key West police. Officers found his birth certificate and a copy of his Alabama’s driver’s license in a backpack left at the pier — but other pieces of identification were also found.

“It’s just not clear and we don’t release names until next-of-kin has been notified,” said spokeswoman Alyson Crean.

Out of respect for the man’s family, who police have yet to locate, the name was redacted from the police report, Crean said.

He remained in critical condition Thursday, but that was all the city could confirm, Crean said. He was flown by LifeNet Wednesday from the pier to a Miami hospital in critical condition.

Police arrived at the pier at about 10:15 a.m. Wednesday to find the man face down in the shallow, rocky water below one edge of the pier, according to the incident report police released Thursday.

Two men were holding the injured man’s head above the water, police said. “We were able to see short, shallow breathing coming from the male face down,” Medina wrote. “The individual was not alert and unresponsive to our voices.”

A plastic Skol vodka bottle was found in the water near the area where the injured man fell, police said. Officers also found a fresh, cold six pack of Busch beer inside a backpack that was attached to the man’s green Nerve bicycle, the report stated.

David Keller, 58, of Key West, told police he noticed a man sleeping on the wall at the end of the pier at about 10 a.m.

Fifteen minutes later, Keller said he looked up and saw the man was missing from the pier. He went over to the wall’s edge and saw the man face down in the rocks and water, police reported.

Two other men went over the rail and grabbed the fallen man, lifting and holding his head above the water until help arrived.

The injured man was estimated to be 6-foot, 2-inches and at least 220 pounds, police said.

Randall Ferrell, 59, of Parkersburg, W. Va., and his brother-in-law David Russell, 54, of Cutler, Ohio, were the two men who jumped over the wall once they realized a man was in the water, police reported.

The injured man earlier had been on the pier acting “belligerent, and began yelling and cursing at people before he fell asleep,” two homeless men told police.

Jury convicts fake Conch Republic diplomat
A 42-year-old man who used satirical Conch Republic identification cards and memorabilia to avoid traffic citations was convicted in federal court in Arkansas for impersonating a foreign diplomat.

The-Nimrod Sterling, formerly known as Nimrod Sanders before changing his name, was convicted on May 21 of pretending to be a diplomat for the Conch Republic while driving around Arkansas in a used limousine with stickers of the fake Florida Keys nation on it, according to federal court records and the Arkansas Democrat-Gazette newspaper.

Sterling represented himself at trial and claimed he could not be cited for traffic tickets or other crimes in the U.S. given his status as a Conch Republic dignitary, which prosecutors rebuffed, explaining to jurors that the Conch Republic is not a real nation, records state.

The jury found him guilty of being a felon in possession of a firearm — a Mossberg 12-gauge shotgun — as well.

A state trooper testified at trial that he didn’t give Sterling a speeding ticket in a construction zone in one incident, because he couldn’t determine if the Conch Republic “was among the foreign governments that are granted immunity through the U.S. State Department,” and that he declined in order to “avoid an international incident,” according to the Arkansas newspaper.

The presiding U.S. District Court judge ordered Sterling undergo a mental health evaluation after listening to his closing statements to jurors, but rescinded the order on Friday after Sterling and prosecutors agreed it was unnecessary, according to court records.

Sterling is scheduled to be sentenced on Aug. 27.

The fake and whimsical Conch Republic nation was formed in 1982 by Key Westers in response to serious concerns over federal road blocks set up on U.S. 1 during the Mariel boatlift, which created headaches for those coming and going from the Florida Keys and hindered tourism. As such, the satirical Conch Republic mockingly seceded from the U.S. as a form of protest.

Fake passports and other diplomatic paperwork sold under the Conch Republic banner have befuddled officials prior to the Sterling case.

The FBI even investigated whether such a novelty passport was issued to 9/11 hijacker Mohamed Atta who was reported to have been in possession of one prior to flying a jetliner into the World Trade Center, according to media reports at the time.

Naked man arrested at Anne's Beach
FREE PRESS STAFF
ISLAMORADA — A naked, registered sex offender accused of exposing himself to multiple families and children was arrested last Wednesday by a state wildlife officer at Anne’s Beach on Lower Matecumbe Key.

Guillermo Alejandro Garcia of Key Largo faces seven charges of indecent exposure, two counts of lewd and lascivious exhibition in the presence of persons under 16, three counts of loitering and prowling, three counts of loitering and prowling in the presence of minors, resisting arrest without violence and disorderly intoxication.

The incident occurred at 5:15 p.m. near the Channel Two Bridge at Anne’s Beach when Florida Fish and Wildlife Conservation Commission Officer Paul Hein was approached by a man and his 17-year-old daughter who told him there was a naked man exposing himself, said FWC spokesman Bobby Dube.

Hein found the suspect hiding in the mangroves, and when he tried to talk to him, the man took off running, Dube said. Hein noted the man appeared “very intoxicated,” Dube added.

“He fled down the boardwalk naked and tried to jump over the railing and fell,” Dube said. He was taken into custody at that point.

As Hein was putting Garcia into a police vehicle, several other families approached and told him they also saw Garcia.

In all, he is accused of exposing himself to four adults, one minor under 18 and two minors under 9, Dube said.

Garcia was taken to Monroe County Detention Center on Stock Island where he remains in lieu of $151,000 bail.

Naked man on channel marker rescued
BY ADAM LINHARDT Citizen Staff
alinhardt@keysnews.com
A man in his birthday suit instead of his bathing suit found stranded on a channel marker was rescued Wednesday after a charter boat happened upon him, according to the Coast Guard.

The man, whose name was not released, had been on a sailboat at anchor near a Northwest Channel marker when he apparently was caught in the current and drifted away while taking a swim.

He was eventually able to cling to the marker and climb up it, according to reports pieced together by responding Coast Guard crews and charter boat mate Chris Green.

A Coast Guard Station Key West response boat rescued the man and returned him to his sailboat uninjured, said Coast Guard spokesman Lt. Peter Bermont.

Green was aboard the 40-foot catamaran, Footloose, operated by Barefoot Billy’s, working a dolphin watching charter when the boat happened upon the naked man about 1:30 p.m., Green said.

The crew didn’t realize the man was naked when they first saw him, Green said. Neither Bermont nor Green said they knew if the man was naked when he entered the water or if he lost his clothes in the current.

Green, 36, and company called the Coast Guard after spotting the man.

The Coast Guard boat crew was already on the water training and was able to quickly respond, Bermont said. They took him back to his boat after removing him from the channel marker.

“I heard about a man stuck on a marker on the other side of Sunset Key a few years ago, but a naked person stuck on one is a first,” Green said.

“It looked like he didn’t know what he was doing and got carried away,” she added.

Darth Vader' helmet stolen during ruckus
BY GWEN FILOSA Citizen Staff
gfilosa@keysnews.com
Duval Street’s banjo-playing Darth Vader had a brush with the dark side this week when someone swiped his trademark helmet.

James Pierce, 46, the street performer who costumes as Vader with banjo chops, was trying to stop two drunken men arguing with a pedicab driver late Monday night and during the dust-up, his helmet turned up missing and was presumed stolen, according to a police incident report.

Pierce had removed the Darth Vader helmet, which he bought for $150 off eBay, and placed it on the sidewalk, he told police. After the commotion, he noticed it was gone.

Police put out BOLO, or be on the lookout, alert for the Darth Vader helmet, which on Thursday remained missing, city spokeswoman Alyson Crean said.

“There are no witnesses and no video footage,” wrote Officer Jeremy Tellier in his report, after having searched the 400 block of Eaton Street for the Vader helmet. “I did not see any video cameras pointing in the area of the theft.”

Pierce on Thursday said he wasn’t hurt during the incident and that he had a spare Vader helmet waiting in the wings.

“The police just happened to be there,” Pierce said. “By the time they arrived, the fight had rather fizzled and I thought, ‘Hell, might as well file a report on my hat.’ “

Pierce, who has logged long hours inside the helmet in the Key West heat, said on second thought he doesn’t want it back.

“It would be like if someone stole my toothbrush,” Pierce said. “Go ahead and keep it.”

Pierce thanked Key West police for their work and blamed himself for the helmet loss. He had a spare helmet given the work conditions on Duval Street for a nighttime street performer masquerading as one of the most despised modern-day villains.

“I get shoved three times a week and punched once every six,” Pierce said. “But I’m taking this as a reminder to embrace positive thought. To avoid the dark side, as it were.”

Adrian Demblans served a year in state prison.
SHERIFF'S OFFICE

A Key Largo man stopped at gunpoint Wednesday afternoon was booked on charges of possessing heroin, cocaine and a weapon, the Monroe County Sheriff's office reports.

Adrian L. Demblans, 34, "was traveling on a skateboard with a leashed dog pulling him" when arrested on Ocean Drive, off mile marker 99.8.

According to a Sheriff's Office report, investigators were watching Demblans after receiving "numerous community complaints" about possible drug dealing in the area. When they tried to stop Demblans around 4:20 p.m., officers said, "Adrian immediately became argumentative and abruptly reached behind his back."

Fearing the suspect could be reaching for a gun, the unnamed officer pulled his own handgun and ordered Demblans to the ground. Demblans reportedly pulled several items from his back pockets and dropped them. He then "became compliant," the report says.

Demblans did not have a gun but was carrying a set of brass knuckles beneath his shirt, officers reported.

A field test of two small plastic bags containing less than half a gram of powder tested positive for heroin, the agency reported. A one-gram cocaine crack rock also was recovered, along with $340 in cash.

Demblans was sentenced to two years in prison after a 2006 arrest on drug-trafficking charges in Miami-Dade County. He served more than a year before his 2010 release, online state records show.

Wednesday, Demblans was charged with felony possession of a weapon by a convicted felon and possession of heroin and cocaine with intent to sell.

Demblans is in the county jail with no bond allowed.

A man was arrested after taking a backhoe for a dangerous joyride on the Seven Mile Bridge. Monroe County Sheriff’s Department spokeswoman Becky Herrin reports the Seven Mile Bridge was closed to traffic for over three hours early today (Tuesday February 16, 2016) after a man dumped boulders on the roadway with a backhoe at the north end of the bridge. He then took the backhoe for a ride, traveling back and forth on the bridge for an hour and a half.

blahnik carl joseph59 year old Carl Blahnik reportedly damaged the roadway and the sides of the bridge with the backhoe as he recklessly traveled first southbound, then northbound changing directions several times. Deputies following him with lights and sirens had to also reverse directions several times to avoid being struck by the backhoe. One deputy’s patrol vehicle was damaged during the pursuit. Deputies finally left the bridge for their own safety, also making sure all other vehicles exited the bridge as well.

Finally, at about 1:20 a.m., Blahnik reportedly drove off the north end of the bridge and waiting deputies threw Stinger Spike strips in front of the backhoe puncturing its tires. The vehicle came to a rest and Blahnik was arrested. He complained of pain in his shoulder and trouble breathing and was taken to Fishermen’s Hospital before being taken to jail.

It took more than an hour and a half to clean the roadway of debris with the assistance of Florida Highway Patrol and make sure the bridge was safe. Traffic was finally allowed to resume just after 3 a.m.

Blahnik was charged with reckless driving, fleeing and eluding police, digging up or any way disturbing any street or highway (FL. Statute 316.2035.3), failing to register a motor vehicle and grand theft of a vehicle.

Blahnik was carrying a Wisconsin identification card at the time of his arrest, but an encounter deputies had with him Monday morning revealed he is possibly homeless and staying in a wooded area near Coco Plum Beach. It is believed the backhoe may have been taken from a construction site at Marathon City Park.

A homeless Key West man faces two felonies and four misdemeanors after allegedly stealing a pickup truck -- which the owner reported stolen after seeing it pass him on U.S. 1 Thursday.

The owner of the white 2009 Dodge Ram 3500, which had Kansas tags, reportedly parked his truck at mile marker 39 and went for a walk (he put his keys in the gas-cap cover). As he walked along a path, he saw the truck heading south on U.S. 1, walked back to where he's staying at the Sunshine Key RV Resort and Marina on Ohio Key and called the Monroe County Sheriff's Office.

The truck and the suspect, Chad Watson, 40, were found in Key West following a crash.

According to a report from Key West police officer Randall Whartle, two U.S. Customs and Border Patrol agents were traveling north on South Roosevelt Boulevard at Flagler Avenue around noon. The agents saw a white truck doing a U-turn north of the light from Flagler.

A nearby maroon vehicle was stopped where the truck did a U-turn. The passenger and driver were outside the car and waved at the agents and pointed at the white truck, leading the agents to believe the truck was involved.

The agents drove behind the truck but Watson reportedly refused to stop and led the pair on a chase on South Roosevelt. Watson stopped when he got stuck in traffic at the U.S. 1 intersection, Hartle wrote.

One of the agents got out and banged on the passenger window, telling Watson, "Stop! Police!"

The report says Watson sped onto U.S. 1 while the agent was still banging on the window. The agents followed Watson over the Cow Key Bridge and into the Hurricane Hole Restaurant, Bar and Marina parking lot on Stock Island.

The agents and crash victims, Dave and Sharon Kowaluk, who apparently also followed, confronted Watson. Dave Kowaluk told the agents he got out of his car after Watson hit his vehicle.

Watson, according to the report, immediately put the truck in reverse and drove away. Dave Kowaluk said Watson almost caused another crash while doing that.

Watson denied driving the truck, Hartle wrote, but did admit he had drunk a lot of Jack Daniels. He told law officers he had been in the parking lot and that the truck was not his.

His misdemeanor charges are drunk driving, damaging property and leaving the scene of a crash involving property damage. His felonies are fleeing and eluding law enforcement officers and grand theft auto.

As of Friday, Watson remained in Key West jail with no bond allowed. He has a 9 a.m. March 3 court date in front of Monroe County Judge Peary Fowler.

Two separate DUI cases
on U.S. 1 kept Monroe
County Sheriff’s Office deputies
working in the Lower
Keys busy, or at the very
least, scratching their heads.
One involved a topless
woman who was fighting
with her girlfriend while
attempting to drive at the
same time Tuesday night
and the other involved a
man found laying on his
back and playing with his
cellphone on the shoulder of
the highway near Shark Key
early Thursday, according to
arrest reports.
Deputy Austin Hopp
received multiple reports
from dispatch of a reckless
driver in a southbound black
Dodge Charger about 8 p.m.
Tuesday at Mile Marker 32
that was not maintaining its
lane or speed.
He stopped the car at
Mile Marker 13 and the driver
opened the driver’s side
door before he approached.
“As I
parked my
patrol car
b e h i n d
the vehicle
and exited
my car, I
could hear
screaming
coming
from inside the Charger,”
Hopp wrote. “I could also
hear a female voice yell, ‘Help
me!’ I approached the vehicle
and observed in the driver
seat, a white female leaning
over the center console and
grabbing another female
with both arms. (The driver)
was not wearing a shirt
and her upper body was
completely undressed. Both
females were shaking, yelling
and pushing each other.”
The driver was identified
as Stefani Claire Godsey, 44,
of Lansing, Michigan. The
other woman was later identified
as her girlfriend.

Police Blotter
• A man who told a Flagler Avenue barber his name was Mark Cable left without paying for his haircut Friday. The man said he worked for dentist Dr. Sandy Pape, but left his checkbook at the office. He said he would return with the $20, but never did. When the barber contacted the dentist, she told him she had planned on hiring Cable as a dental technician, but never did based on a background check that contained numerous convictions for fraud and aggravated assault. The barber said he was concerned the man would steal from other businesses and Pape told police she was concerned that Cable was going around town telling people he was a dentist at her office. A warrant for the man’s arrest was filed.

• A woman on Seidenberg Avenue was attacked by a man on a BMX bike late Friday night. She told police a white man in a gray hoodie jumped off his bike and tackled her to the ground. He stated “this is from Rodrigo,” and then got back on his bike and left the scene. She was not seriously injured in the incident. The report did not state whether the woman knows a “Rodrigo” or if she had any idea what prompted the incident.

• Police were called to the Publix in Keys Plaza at 8 a.m. Sunday after a homeless man started yelling in the store that someone stole his bicycle he left parked outside. The man was angry that employees were not letting him review security footage of the incident. He calmed down and police told him to call them if he sees someone on his bicycle.

The department received a call Tuesday morning to help a woman stuck in a tree that she attempted to climb.

Not "in" the tree like a cat on a branch.

But IN the tree.

According to the department's Facebook page, officer Scott Standerwick and the a Fire Rescue unit responded after learning that a local woman (yes, she actually lives in Key West) was stuck inside a giant banyan tree.

The photo shows the woman wedged in the branches of the tree, thankfully hiding what is sure to be her embarrassed face.

Officer Standerwick and the others were eventually able to free her from her tree torture.

"They popped her out like a cork," a Key West Police Department spokesperson told Local 10.

Marathon man enters sheriff race
BY ADAM LINHARDT Citizen Staff
alinhardt@keysnews.com
A 44-year-old Marathon man with a checkered past with the Monroe County Sheriff’s Office has thrown his hat into the ring for sheriff.

Independent Kevin Wolszczak is looking to upset incumbent Republican Rick Ramsay in the Nov. 8 General Election.

Wolszczak did not return phone calls seeking comment Thursday. Wolszczak does not have any law enforcement employment history in Florida, according to the Florida Department of Law Enforcement.

Wolszczak has had multiple run-ins with law enforcement, notably the Sheriff’s Office, dating to last year that include yelling at various store clerks — one of which led to his arrest in March — and run-ins with neighbors who he claimed were shooting firearms, which deputies later determined to be firecrackers, according to myriad Sheriff’s Office reports.

Wolszczak was most recently arrested on March 3 at a drug store on Big Pine Key when he reportedly spit on a store clerk, reports say.

The clerk asked Wolszczak to remove sunglasses so she could properly identify him, given he was buying alcohol, when he became irate and cursed the woman, reports say. During the exchange he reportedly claimed to be ex-military, a retired congressman and a lawyer.

As he was leaving the store, he reportedly spit on the clerk, which a Sheriff’s Office deputy saw in a store video. Wolszczak was arrested shortly thereafter on a misdemeanor battery charge that remains pending in court.

On March 12, deputies were called to Wolszczak’s residence regarding a shots fired call. He claimed a neighbor had fired a gun and that he was not going to be intimidated, reports say. Deputies later determined that neighbors had blew up a firecracker in an effort to get Wolszczak to turn down rock music that he had been loudly playing, reports say.

There were no arrests in the case.

On Feb. 25, deputies were called to Wolszczak’s residence in Marathon after receiving reports that he was causing a disturbance and claimed to be armed with a gun, reports say. In that incident, deputies put the SWAT team on alert and readied spike strips after Wolszczak got into his vehicle and drove behind the house, reports say.

It was later determined that he was not armed. He was not arrested in that incident.

Ramsay declined to comment.

Wolszczak has until noon, June 24 to qualify for the race. He must pay $4,775 in order to qualify for the November election, according to the Monroe County Supervisor of Elections office. He missed the May deadline to file signatures to qualify to run and now must pay the $4,775 in order to run.

Bar brawl breaks out, breaking wind, broken shoulder: 'The argument was due to someone farting.'

In this bar fight at one of Key West's most famous watering holes, it wasn't a spilled drink or sleazy advance on someone's wife that led to blows.

According to the police report, a fight broke out between two couples this week when someone, who Friday remained unidentified, allegedly broke wind inside Sloppy Joe's, 201 Duval St.

"The argument was due to someone farting," police were told by a man who went to the hospital for a dislocated shoulder after the Monday night scrap.

Richard McBride, 53, and his girlfriend Sandra Stoner, 55, both of Naples, said they were caught up in a physical altercation after the argument arose "over a fart," Officer Igor Kasyanenko wrote.

The couple said they were drinking with friends at the bar when Stoner traded words with an unidentified woman before getting out of her seat and confronting her in "an aggressive manner," police said.

An unidentified man tried to pull the woman away as others began to step into the dispute, including McBride, who pushed the man, police said. The man retaliated by striking McBride in the face and McBride responded by tackling, Stoner told police.

The unidentified couple took off and police said they couldn't find them. Later at Lower Keys Medical Center, McBride said he didn't want to pursue charges and signed a release form.

City board member faces felony charges
BY Scott Unger Key West Citizen
Key West Sustainability Advisory Board member Richard Lightner was charged with felony battery and felony resisting arrest following an incident at a New Town restaurant Tuesday afternoon.

Police were called to the Outback Steakhouse, but found Lightner, 71, nearby at Sweet Fire Chipotle, 3220 N. Roosevelt Blvd., at 4:38 p.m. as he was walking out of the restaurant’s front door, according to Key West Police.

They noticed an empty gun holster on his hip and found a filet knife on his person, as well as a multi-tool, reports state.

Lightner was reportedly asked to leave the steakhouse after calling a patron a terrorist and shoving the manager. Lightner appeared drunk and at first said he had diabetes and then denied it while telling police he would sue them, reports state.

Lightner kicked one officer and tried to trip him while he was being placed in custody, reports say.

Once in the police car, a Sweet Fire Chipotle employee informed officers that some of his property was still in the business. Police found a loaded .40-caliber Glock under a shirt, reports say.

Lightner, a former treasure salver, was appointed to the Sustainability Board on Nov. 5, 2015. He is also a Florida Green Building Coalition Certifying Agent. Lightner has also been a licensed real estate broker and certified builder since 1979, according to his resume.

Last year, Lightner filed a police report concerning a missing sign-in sheet at a meeting about cistern use.

He told police multiple speakers and citizens signed the sheet, but he added there were also “several activist groups opposed to the subjects being discussed,” reports say. Lightner told the officer the meeting was civil; however, he believed someone from one of the activist groups may have taken the sign-in sheet. No action was taken in the case.

Lightner was taken to Monroe County Detention Center on Stock Island and was released Wednesday after posting $5,000 bail.

A North Toledo man pleaded not guilty today in Toledo Municipal Court to chasing a family member with a hatchet.

Noel E. Dawson Jr., 63, of the 400 block of Elder Drive, is charged with domestic violence, assault, both first-degree misdemeanors; criminal damaging, a second-degree misdemeanor; and failure to disclose personal information, a fourth-degree misdemeanor.

Toledo Municipal Court Judge Robert Christiansen set bond at $50,000 Tuesday with no option to post 10 percent. The case was continued to today.

Mr. Dawson pleaded not guilty today to the charges.

Mr. Dawson is accused of chasing a family member Sunday with a hatchet. Prosecutors allege he swung the hatchet at the man, but struck his truck instead — leaving a large dent in the hood, according to a complaint filed in Toledo Municipal Court.

When Mr. Dawson was arrested, he refused to give the officer any of his information and rather just shouted obscenities, court records show.

Report: Man takes golf cart home
ISLAMORADA — A 23-year-old man accused of making off with a $2,500 golf cart from Robbie’s Marina last Thursday was arrested, according to the Monroe County Sheriff’s Office.

John Robert Liautaud was charged with felony grand theft.

Deputies were called to the 77000 block of the Overseas Highway for a domestic argument where Liautaud told them he had been drinking all day and fighting with his girlfriend after they rented kayaks from the marina, reports say.

He returned the kayaks and didn’t want to walk to a family member’s home nearby, because he was drunk, so he asked a marina employee if they could drive him home in one of their golf carts, reports say. The employee told him that his boss would not like the golf cart leaving the property.

Liautaud said he drove the golf cart away after the employee left and it was found at his family’s member’s home undamaged, reports say.

A manager at the marina said they wanted to press charges.

Liautaud was taken to the Plantation Key jail.

BIG PINE KEY — A drunken man accused of leaving his wallet inside a bulldozer used for debris removal was arrested Thursday morning, according to the Monroe County Sheriff’s Office.

Mark Moses, 65, of Big Pine Key, was charged with burglary and criminal mischief.

An employee for bulldozer company Unlimited Debris met with the Sheriff’s Office at 9 a.m. after discovering someone had damaged the machine overnight, reports say.

The windshield was broken as well as both the right and left mirrors, reports say. The employee told the deputy he found a wallet, a pair of sneakers, spilled beer and cigarette butts inside the cabin, reports say.

Moses’ identification was reportedly found in the bulldozer cabin as well as his social security card and veteran’s affairs card. Moses was later found at a grocery store.

He reportedly admitted to the burglary and identified the wallet and sneakers as his, but said he had no memory of the incident.

He was taken to the Monroe County Detention Center.

A drunken Hialeah man crashed a car through the brand new gate at Fort Zachary Taylor State Park, then crashed onto rocks on the beach at Naval Air Station Key West before running barefoot from police early Monday morning.

Lino Dejesus Aguirre Treminio, 32, was charged with DUI with property damage, DUI with a blood alcohol content of .15 or higher, leaving the scene of a crash, resisting arrest and driving with a suspended license.

Aguirre Treminio had a blood alcohol content of .179, according to police. He told police he had been drinking at a strip club, the name of which he couldn’t remember, and that he remembered only leaving the club, driving and smashing through the gate, reports say.

He had beers, “large mixed drinks,” smoked marijuana and had taken Advil PM, reports say.

The ruckus began at 1:26 a.m. when a witness reported seeing a sedan, later identified as a Nissan driven by Aguirre Treminio, drive through the gate at the park, back up and hit the gate again, according to police.

Arriving police followed fresh tracks in the sand to the Nissan that was found stuck on the rocks at the beach on NAS Key West property.

Aguirre Treminio exited the driver’s seat and made haste to the tree line while police yelled for him to stop. Officers called Navy police to alert them to the situation as a bevy of officers descended on the scene looking for the driver.

Aguirre Treminio was found shortly thereafter lying on the ground near a fence. A set of keys that matched the Nissan fell out of his pocket, reports say.

He told officers he was “sorry” and that they “saved” him.

There was no one else in the Nissan and no other vehicles involved, reports say.

Police found Aguirre Treminio’s shoes, which he had lost in the incident, and asked him to perform field-sobriety tests, which he reportedly failed.

He was taken to the Monroe County Detention Center on Stock Island.

Reports did not state how much it would cost to repair the new gate to the park. The gate was part of a $1.7 million project that also installed sidewalks, bike lanes, fencing and lighting. The new gate was dedicated by park, Navy and city officials in May.

Deputies: Keys woman charged after shots fired at boats

KEY WEST, Fla. (AP) - Authorities say a Florida Keys woman is facing felony charges after a confrontation in which shots were fired near boats she wanted to scare off.

The Monroe County Sheriff’s Office said in a news release that 51-year-old Lelena Sue Moses is charged with aggravated assault with a weapon without intent to kill. She was released on $5,000 bail Saturday.

Investigators say Moses told them boats were “sneaking around” a houseboat she shares with her husband off Cudjoe Key. The boaters told deputies shots were fired and they saw Moses holding an AR-15 style rifle.

Authorities say Moses claimed it was her husband who fired the warning shots with a handgun. But the boaters said they never saw the husband fire a gun.

Key West port of call closed after boat crashes into mooring

port of call in Key West 's famous Mallory Square is unusable for at least three months while it is repaired for damage caused by a cruise ship crash.

City officials said this week that the cost of repairs could be as much as a half million dollars.

The Miami Herald reports the 691-foot-long Silversea Silver Spirit cruise ship was leaving Mallory Square two weeks ago when the winds stopped it from turning around to get underway.

The ship crashed into a mooring, damaging a large concrete block atop pilings.

Key West has two other ports of call at the Outer Mole Pier at the Truman Waterfront Park and at the Margaritaville Resort near Mallory Square.

Man invited a woman to crash on his boat. Now he’s off to prison for attacking her

A Key West man faces up to 15 years in prison for sexual battery on a woman he invited to his boat earlier this year. During the assault, he told her to “stop playing the victim,” and be grateful he gave her a place to stay.

Miguel Pestano, 44, three times forced himself on the woman who needed a place to crash Jan. 6 and ended up on his boat on which he lived moored off Stock Island, a Monroe County jury decided on Dec. 5.

The victim this week told the jury about her ordeal, including what Pestano said during the attack.

Judge Mark Jones, who presided over the case, is scheduled to sentence Pestano on Jan. 11.

Pestano didn’t testify at trial but he told police different stories when he was arrested Feb. 12.

At first Pestano said he didn’t know what they were talking about. But then under questioning he said he had sex with the woman but only with her consent.

He also said he didn’t have to rape anyone because his girlfriend is “hot.”

The case was prosecuted by Assistant State Attorneys Patrick Flanigan and Christine Poist.

In 2006, Pestano was sentenced to two years in prison for an aggravated assault with a weapon without the intent to kill.

That's not that many over the limit, is it?

How many fish did a captain catch off the Keys? Cops say boat had 2,611 over the limit

He also said he had a license that allowed him to keep an unlimited amount of pompano, the report states. The FWC officers, however, told him he was outside the Pompano Endorsement Zone, and was only allowed to keep 100 as bycatch, according to the report.

Pompano is a member of the jack family, and a stout, strong-swimming sport fish sought by commercial anglers looking to sell their catch to wholesalers and restaurants.

After following the 52-year-old Birren back to his Everglades City dock, officers found he had caught 2,711 pompano, placing him way over the limit, according to the report. The officers also said 76 of the fish were smaller than the legal size of 11 inches to the fork of the tail.

On the way back to the dock, one of the officers stayed on board of the Legacy. When he entered the wheelhouse, he overheard Birren on his cellphone complaining to someone that he was set up.

Officer Jeremy Foel wrote in his report that Birren told the person on the other line: “Someone called on me.” He also said, according to the report, “They wouldn’t have ever even knew I was there if it wasn’t for that mother f---er calling. I was 18 miles off shore.”

Billionaire’s son killed by boat propeller while trying to save fiancée

The son of a billionaire banker was killed by a boat propeller while desperately trying to save his fiancée during a Florida Keys fishing competition.

Juan Carlos Escotet Alviarez — the 31-year-old son of Venezuela-based Banesco president Juan Carlos Escotet Rodriguez — died Saturday afternoon after jumping into waters about six miles off north Key Largo as he and fiancée Andrea Montero, 30, tried to snag sailfish from a 60-foot boat, the Miami Herald reported.

Escotet Alviarez dove into the water to try to save Montero when she fell overboard, but hit the vessel’s propeller immediately and died from his injuries, according to a Florida Fish and Wildlife Conservation Commission report obtained by the newspaper.

The pair were taking part in a fishing tournament organized by the Ocean Reef Club in Key Largo. The FWC report did not cite Montero’s condition and a call seeking additional comment from the agency was not immediately returned Monday.
