Here's the scenario....

I had a guy do some work for me this past year on a temporary basis under his business. I basically subcontracted window tint work through him until I found an in house fulltime guy to do it.

Fast forward to now...

Being the dumb a$$ that I am I did not get his address and Social so I could send him a 1099 form. Tried to call him and he won't talk to me.

Anyone know how I can get his addy and social so I can send him one in the mail? I'm willing to pay a small amount to a people search if I have to. Just don't think I'll get a social from that.

I believe 1099's and W-2's were supposed to be done by Jan 31st.......

If he did less than $600 of work then you can get away it without the 1099/W-2. If you get in a jam you could always label his work as "materials" but I am no accountant! :D

My accountant informed me that W-2s are due by Jan 31st and 1099s are due by end of February.

He did about 5-6k worth of work.

I realize there are ways around this, but I'm hoping to take the high road if possible.

Buck,

In case you are not aware, legally you need to get a completed and signed W9 form. Get this form before you pay them anything, it helps avoid this situation (I've been there myself). I've had guys actually lie when filling out these forms and I was glad I had the W9's on file to send to the IRS when they questioned the SS#'s on 1099's that I had submitted.

Especially since he's trying to evade paying his taxes. I hope he gets busted.

I'm about 1,000,000% sure he hasn't filed yet. My digging has revealed failure to file a return for several years now.

Your accountant is mistaken, W-2's and 1099's are supposed to be mailed by 1/31, the 1096 and irs copy of 1099 is due by the end of Feb. However, sending 1099's late is rarely an issue as the intended recipient has to complain to the IRS about it being late for it to cause a problem.
