The Truth About the Health Care Bills - Michael Connelly, Ret. Constitutional Attorney

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S.. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law It doesn't stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

People are outraged; that is why they are cutting deals behind closed doors and will ram this thru despite overwhelming opposition.

America is on the auction block, and the Executive and Legislative branches of the Federal Government are the auctioneers. The American citizens expect their elected officials to “bring home the bacon,” which means get more Federal dollars coming back home than they are sending to Washington. American citizens want more than their share.

America wants socialism.

Over the past 100 years, American citizens have become addicted to the money that comes to them from Washington. It comes as fat defense contracts to little machine shops, farm subsidies, student loans, Freddie Mac and Fannie Mae, The GI Bill, Medicaid, Medicare, Social Security…and the list goes on. Because most Americans have their taxes automatically withheld from their paychecks, they don’t feel the weight of their tax burden. So, it FEELS like benefits are flowing from Washington back to home.

America wants socialism.

In 2008 and 2009, the Federal Government nationalized the banking industry, the investment industry, a giant insurance company and part of the automobile industry. America barely made a peep.

America wants socialism.

Afore-mentioned Social Security, Medicare and Medicaid, the biggest entitlement programs in the history of the planet, have become as familiar as the air we breathe. Conservatives in Washington accepted the big social welfare programs long ago, and don’t lift a finger any more to fight against them…or even try to control their budgets. In fact, some of the biggest spending legislation ever enacted came from Washington while Conservatives controlled the House and Senate, and Republicans lived in the White House.

America wants socialism.

America totally forgave George Bush for lying the USA into a Middle East war. American has completely accepted an ever-expanding worldwide military, and embraced the wars in Kuwait, Iraq and Afghanistan. They festoon everything with yellow ribbons, and “support the troops”…even when the troops are murdering foreign civilians and violating the Constitution with their actions abroad. (By the way, a tenet of communism was to spread communism by military action. Americans think we’re trying to spread democracy.)

America wants socialism.

Washington politicians have gutted what was left of the Constitution since 2001. Individual liberties have been destroyed. The Patriot Act was enacted, the Transportation Safety Administration made airports into “no-rights zones,” and the Department of Homeland Security has vastly expanded its power over American citizens. All done with only a few whimpers and few objections.

America wants socialism.

The Obama Administration is taking this window of opportunity to take over health care and health insurance in the USA. American citizens have watched the nation’s insurance companies destroy the health insurance industry. There are over 45 million Americans today without any health insurance at all. So, Obama and Congress have the political cover to do a government takeover. American citizens are exhausted from fighting to get health insurance. They want health insurance at any cost, and are willing to trust Uncle Sam to run the healthcare and health insurance system.

Americans want socialism. And Americans are getting socialism as quickly as Washington can deliver it.

I always used to think that America was being misused and abused by Washington. I have changed my thinking about that. I believe that Washington is simply giving America what it wants.

Perhaps the Washington politicos are the most astute observers of human behavior. They are certainly the best at survival.

Curious, though…that last sentence also aptly describes the relationship between a leech and its host.

Joseph Stubbs, president of the American College of Physicians — the second-largest doctors’ group in the country — confirms that “the supply of doctors just won’t be there” for the 30 million new patients President Barack Obama wants to cover. Noting that the doctor shortage is “already a catastrophic crisis,” Stubbs noted that underserved areas in the U.S. currently need almost 17,000 new primary care physicians even before Obama’s proposals are enacted.

In the meantime, according to Bloomberg News, a 2009 survey by Merritt Hawkins & Associates, a recruiting and research firm in Irving, Texas, found that “the average waiting time to see a family-medicine doctor in Boston … is 63 days, the most among the 15 cities” surveyed. By comparison, in Miami, it was only seven days. The study noted that Boston’s longer wait was “driven in part by the healthcare reform initiative” passed in 2006 in Massachusetts, upon which the Obama program is modeled. Bloomberg reported that “as many as half of doctors in the state have closed their practices to new patients, forcing many of the newly insured to turn to emergency rooms for care.”

Alan Goroll, a professor at Harvard Medical School, said that “the primary lesson of healthcare reform in Massachusetts is that you can’t increase the number of insured unless you have a strong primary-care base in place to receive them. Without that foundation … Massachusetts has ended up with higher costs and people going to emergency rooms when they can’t find a doctor.”

Additionally, a study by the Centers for Medicare and Medicaid Services, part of the federal government’s Health and Human Services Department, found that expanding insurance coverage to an estimated 32 million people who now lack it would create a demand for medical services that “could be difficult to meet initially … and could lead to price increases, cost-shifting and/or changes in providers’ willingness to treat patients with low-reimbursement health coverage.”

Indeed, the report found that the Medicare cuts contained in the House-passed bill are likely to “prove so costly to hospitals and nursing homes that they could stop taking Medicare altogether.”

I don't know why any one would want to become a Doctor if this passes; then what? Coverage means crap if there isn't any one that takes it..

Our neighborhood is full of Doctors, currently one of the daughters is a Jr in high school and she thinking about becoming a doctor. Her dad, who's a doctor told her to wait on choosing a career until they see if the health care bill passes. If it passes don't become a doctor do something else. These are his thoughts not mine, this girl is my daughters best friend.

My fiancé teaches pediatrics to 3rd year students at Georgetown University. Majority of them are having 2nd thoughts on their health care careers and only 3-4 out of the last 45+ students are even considering general practice. Sub 10% doesn't sound very good.

She also precepts (on the job training, students come to her work to watch her work) about a student a week and almost all of them are scared to death as well. Most are carrying 6 figure student loans and not sure they are going to be able to earn a decent living.

has anyone thought about the internal revenue service will be in charge of health care?
